Minimum Housing Standards

Finding and Purpose

(a) Pursuant to N.C. G.S. § 160D-1201, it is hereby found and declared that there exist in the Town of Sunset Beach dwellings which are unfit for human habitation due to dilapidation, defects increasing the hazards of fire, accidents and other calamities, lack of ventilation, light and sanitary facilities, accumulations of garbage, trash and/or rubbish on the premises, or overgrowth adversely affecting the health, safety and/or well-being of the occupants, or other conditions rendering such dwellings unsafe or unsanitary, dangerous and detrimental to the health and otherwise inimical harmful to the welfare of the residents of the Town.

(b) Pursuant to N.C. G.S. § 160D-1129, The Town further finds that there exists within the Town non-residential buildings and structures that appear to be dilapidated, vacant or abandoned and to be in such a condition as to cause or contribute to blight, disease, vagrancy, fire or safety hazard, to be a danger to children, or to tend to attract persons intent on criminal activities or other activities.

(c) In order to protect the health, safety, and welfare of the residents of the Town it is the purpose of this ordinance to establish minimum standards of fitness for the initial and continued occupancy of all buildings used for human habitation, as expressly authorized by G.S. 160D-1205

(d) The provisions of this Chapter shall apply to all residential and non-residential buildings and structures within the Town of Sunset Beach as now or hereinafter affixed.

(e) The provisions of this Chapter shall not apply to any structure exempt from regulations under the Town of Sunset Beach Unified Development Ordinance and as otherwise exempt by statute or other applicable laws.
