Board of Adjustment Member

The Sunset Beach Town Council is accepting applications for two (2) Board of Adjustment members. Applicants must reside inside the Town's corporate limits.

The Board of Adjustment hears and decides appeals of administrative decisions, variance requests, and special use permits in a quasi-judicial setting. Members apply North Carolina law and the Town’s Unified Development Ordinance to ensure the spirit of the ordinance is observed, public safety and welfare are secured, and substantial justice is done.

• Hear and decide appeals of decisions made by officials charged with enforcing Town development ordinances.
• Hear and decide applications for variances when strict application of the ordinance would create unnecessary hardship, and ensure any granted relief is consistent with the ordinance’s intent.
• Hear and decide special use permits in accordance with statutory quasi-judicial procedures.
• Follow North Carolina General Statute procedures for quasi-judicial hearings, including taking sworn testimony, evaluating competent, material, and substantial evidence, and making findings of fact.
• Abide by the board’s rules of procedure, attend meetings as scheduled, and participate in votes that require a majority for most matters and a four-fifths vote to grant a variance.

• Must reside within the Town of Sunset Beach corporate limits at the time of appointment and throughout service.
• Willingness to complete orientation and training on quasi-judicial procedures, conflicts of interest, and applicable Town ordinances.
• Commitment to regular attendance and adherence to board meeting schedules and rules of procedure.

• Familiarity with planning, zoning, land use, or related fields such as construction, surveying, real estate, architecture, or law.
• Ability to read site plans and evaluate testimony and exhibits.
• Strong listening skills, impartial judgment, and comfort with formal hearing procedures and public deliberation.
• Prior service on a board or commission, or experience with quasi-judicial proceedings, is helpful but not required.
